FACT OR FICTION? - MULTIPLE REPRESENTATION

When a buyer and a seller are clients of the same brokerage, it’s known as “multiple representation.” That’s also the case even if the buyer and the seller are working with different sales representatives within the brokerage.

FACT

When a client signs a representation agreement as a buyer or a seller, they are entering into a contract with the brokerage, not the specific salesperson or broker that they are working with.

Although multiple representation is relatively common, it still requires disclosure by the brokerage and the client's written consent before proceeding.
